Terms of sale
Tourmaline Safaris provides its services subject to the terms and conditions imposed by the terms of sale.
1- Definitions
Guest and passenger design all individual, group, company or other legal entity using Tourmaline Safaris services, and includes passengers agents.
Services design the transport or/and accommodations services or/and meals proposed by Tourmaline Safaris agreed by the passenger.
Partners design every entity, organisation, company : hotels, car rental company, flying company providing all or part of the services at Tourmaline Safaris.
Departure date design the planned departure date for the beginning of the services.
2- Quotation
a- The quotation is subject to accommodations and vehicles availability at the service reservation time.
b- All itinerary changes will involved a changed in its price.
c- The quotation is based on actual prices, on the quotation day. If because of inflation, the rate such as hotel rate or rate of any of the others (accommodation, petrol, taxes, change rate, entry fee, etc…) change, Tourmaline Safaris has the right to change its quotations prices in consequence.
d- No price modification will be allowed after that Tourmaline Safaris will have received the total service payment.
3- Reservation
a- Reservations must be send by writing to Tourmaline Safaris (email/facsimile)
b- A reservation is considered as confirmed only after Tourmaline Safaris as received a 30% deposit from the total service amount.
c – Tourmaline Safaris book the requested services, on reception of the written reservation and of 30% deposit, those booking are subject to availability.
d- In the case where, the services (accommodations) included in the quotation should be unavailable, Tourmaline Safaris would replace them by services of equivalent standard. If the new service should be of a lower standard to the quoted one, Tourmaline Safaris would refund the difference.
4- Payment
a- A 30% deposit of the total service amount is required at the service reservation.
b- Full pre-payment is required 60 days before departure.
c- If reservations is made less than 60 days before departure, full pre-payment must be joined to the service reservation.
d- Payment must be done either by bank transfer on Tourmaline Safaris bank account in Namibia which details will appear on the invoice or by credit card.
5- Customer cancellation
All service cancellation must be send by registered letter to Tourmaline Safaris postal address PO Box 40 739 Windhoek Namibia and by E.mail at our internet address info@tourmalinesafaris.com. Cancelation can only be effective on reception during office hours, week ends and public holidays doesn’t allow us to process a cancelation as all service providers offices will be closed.
The passenger is subject to the following cancellation fee :
61 days en more : 25% of total service cost.
31 – 60 days : 50 % of total service cost.
16 – 30 days : 75 % of total service cost.
0 – 15 days : 100% of total service cost.
While our cancelation policy does its best to cover the a policy of most service provider some service providers have tougher policy when that will be the case, Tourmaline safaris will have to apply this special policy on the specific service.
6 – Modifications or cancellation by Tourmaline Safaris
a- If in major force circumstance linked to passengers security, Tourmaline Safaris is constrain to modify the tour or service, the guest will not be allowed to clamed any refund.
b- In function of unpredictable event such as road conditions, meteorological, mechanical, geopolitics… we may have to modify and adapt the itinerary in accordance to those conditions.
c- While Tourmaline Safaris is doing its best in order to be sure of its product validity and of the quality service given by the partners, Tourmaline Safaris and its agents can not in any circumstance be held responsible for one partner defection.
d- If the number of registered people doesn’t reach initial expectation, the departure could still be guarantee nevertheless on condition of an extra charge.
7- Insurance
a- Tourmaline Safaris services do not includes insurance cancellation, curtailment, medical expenses, personal baggage, emergency evacuation, medical assistance and money.
b- Insurance submission to a comprehensive insurance covering guest for medical expenses, medical assistance and emergency evacuation is a sine qua none condition for a the use of Tourmaline Safaris services. All insurance details with reference number and contact number will have to submitted to Tourmaline Safaris before departure.
8- Responsibility
a- Tourmaline Safaris declines all responsibility in case of delay due to accident, mechanical breakdown or any other causes.
b- Neither Tourmaline Safaris nor any person acting for, through or on behalf of Tourmaline Safaris shall be liable for any loss or damage whatsoever arising from any cause whatsoever and without restricting the generality of the foregoing shall particularly not be responsible for loss or damage arising from any errors or omissions contained in its brochure or other literature, late or non-confirmation or acceptance of bookings, loss or damage caused by delays, sickness, injury or death, whether occasioned by negligence or not
c- In addition Tourmaline Safaris shall have the right to, at any time, at its discretion, cancel any tour or the remainder thereof or make any alteration in route, accommodation, price or other details and in the event of any tour being rendered impossible illegal or inadvisable by weather, strike, war, Government or interference or any other cause whatsoever. The extra expenses incurred as a result thereof shall be the responsibility of the passengers.
d- Tourmaline Safaris may, at its discretion and without liability or cost at itself at any time, cancel or terminate the passenger’s booking and particular without limiting the generality of the foregoing it shall be entitled to do so in the event of illness or the illegal or incompatible behaviour of the passenger, who shall in such circumstances not be entitled to any refund.
9- Health
Concerning this chapter Tourmaline Safaris declines all responsibility. Also it is recommended to the passengers to take medical advice from a doctor. The passenger must inform Tourmaline Safaris before departure of every medical problem or particular sanitary condition he may be subject to. There is no age limit for a safari but being in good health is a sine qua none condition to all departure. Some specific activity may require excellent physical abilities, participation to those activities may require a medical certificate.
10- Authority on tour
a- At any time on a tour, the guide have authority to take necessary decisions in order to assure the security and well being of all passengers.
b- The passenger must behave according to the visited country law enforcement.
c- The guide will be able to modify and adapt the itinerary in according to road conditions, meteorological or mechanical matter.
11- Accident
Please be aware that a safari may take you into close contact with wild animals. Attacks by wild animals are rare, but no safari into African wilderness can guarantee that this will not occur. Neither Tourmaline Safaris, not their employees can be held responsible for any injury or accident on the safari.
Under no circumstance, Tourmaline Safaris nor any person acting for, through or on behalf of Tourmaline Safaris shall be liable for any loss or damage whatsoever arising from any cause whatsoever and without restricting the generality of the foregoing shall particularly not be responsible for any injury, decease, loss or any other kind of damage that may arise at the passenger whatsoever are the circumstances.
12- Baggage
For safety and because space is restricted, baggage in charter aircraft is restricted to a maximum of 12kg per person in a soft bag. Should guest arrive with excess baggage without prior warning their baggage could be delayed as we may have to fly the baggage into camps at later stage at considerable extra cost to you. However should the guests know in advance that the baggage will exceed the limit, we can usually book an extra seat for the bags on the aircraft, at an additional cost.
Baggage and personal effect is the passenger responsibility, Tourmaline Safaris can not be held responsible for any damage or loss.
13- Visas
The onus is upon the guest to ensure that passport and visas are valid for the countries visited. The company, their staff and their agents cannot be held liable for any visas, etc… not held by the guests, nor the cost of visas.
14- Photography
Tourmaline Safaris reserves the right without further notice to make use of any photograph or film taken on safari by our photographers for general publicity purposes without payment or permission. We guarantee that no photographs of a compromising nature will be used.
15- Consent
The payment of the deposit or any other partial payment for a reservation on a safari constitutes consent by all guests covered by that payment to all provisions of the conditions and general information contained this document whether the guest has signed the booking form or not. The terms under which you agree to take this safaris, cannot be changed or amended except in writing, signed by an authorised director of the company.
Some partners may impose age limit or restricting conditions to access there services not detailed in this document, all booking done through Tourmaline safaris involves that the passenger accept the booking terms and conditions of all partners he may indirectly use the services.
16- Law
Those bookings terms and conditions are done according to the Namibian law.
This correct at its publication time, Tourmaline Safaris can not be held responsible for any change that may arise subsequently.
